AI in Ontario Hospitals and Clinics: What PHIPA Actually Requires Before You Deploy

Ontario hospitals and medical clinics face specific PHIPA obligations before deploying any AI tool that touches patient data. Data location alone does not satisfy the law — here is what does.

Across Ontario, hospitals, family health teams, and specialist clinics are under pressure to adopt AI — for clinical documentation, diagnostic support, referral triage, and administrative automation. PHIPA places a clear obligation on health information custodians (HICs): before sharing personal health information with an agent or service provider, you must have a written agreement that restricts the agent to only the purposes you authorise and requires them to protect PHI to a standard equivalent to your own. Most US-based AI vendors — including those offering "Canadian data residency" — cannot satisfy this requirement because they remain subject to the US CLOUD Act, meaning a US federal court can compel production of your patients' data regardless of where the servers sit. For Ontario clinics and hospitals evaluating AI vendors in 2026, the compliance question is not "where is the data stored?" but "under whose law is the data governed?"

Sovereign AI Gateway is an Ontario-incorporated CCPC with infrastructure physically located in a Toronto colocation facility, operated entirely under Canadian law. We have no US parent company and no exposure to US federal court orders. When Ontario custodians deploy AI through our API, the data processing agreement we provide is governed by Ontario and Canadian law — not a US contract clause. Every inference request produces a cryptographically signed attestation that your compliance officer can verify independently, giving you an auditable record for IPC submissions and accreditation reviews. If your health system is evaluating AI vendors and needs a vendor that can genuinely satisfy PHIPA's agent agreement and sovereignty requirements, book a compliance call and we will walk through the documentation your legal team needs.
